"you" & "you're" refer to the user, which includes all users of this site, including

customers, vendors, merchants, browsers, and/or contributors of material &

content. The terms "website" & "site" refer to the FineShapeWorks website.

 

By accessing & using the website you (the "User") agree that you have read, understood

& accept to be bound by these terms & conditions & all applicable laws & regulations.

You are responsible for compliance with any applicable local laws & policies. 

 

If you do not accept any of these terms & conditions, you are not allowed to use or access the website including all information, materials, tools & services available from this site.  The materials contained in this website are protected by applicable copyright & trademark laws.

The copyright in all material provided on this site is held by FineShapeWorks except as permitted by FineShapeWorks. You agree and accept that no material can be copied, modified, reproduced, published, downloaded, distributed, used in any manner without express permission from FineShapeWorks or the copyright owner.

We make no representation for accuracy, reliability and likely results the use of the materials by Any reliance on the material on the site is at your own risk. We reserve the right to update, change or replace the contents of the website as and when we require it. Use of any linked site on the internet web site of FineShapeWorks is completely at the user's risk as FineShapeWorks has not reviewed all of the sites linked to its internet website and takes no responsibility of content on any such linked site. Also, the inclusion of any link does not imply endorsement by FineShapeWorks of the site.

6. Confidentiality

We confirm confidentiality in all communication relating to your brand or business.  Communications will only be done with you or your authorized representative(s). Any information provided by you will not be shared with anyone outside our organization, subject to our privacy policy.

7. Work and delivery output

Although we accept unlimited requests, our volume of output is dependent on the complexity of requests or total request volume. We will make every attempt to work with you in case of time-sensitive requests but we do not provide any assurance for such requests

8. Output files

While we try to curtail any mistake, we cannot guarantee that all files delivered will be 100% error-free due to the creative nature of designs. At the time of delivery, you agree to review and inform our team about any errors or omissions along with corrections/changes (if required) in the files. We will do our best to rectify our mistakes and make any changes.  FineShapeWorks should not be held responsible or liable in case of any losses or expenses suffered due to errors and omissions.

9. Knowledge base analysis

You accept that you have understood and viewed the content in our knowledge base on how our tools work and its scope of service.

10.Limitations

In no case shall FineShapeWorks, our owners, officers, employees, affiliates, agents, interns be held liable for any injury, loss, claim, direct, indirect, or consequential damages of any kind  (including negligence, loss of data, lost profits , due to business interruption) appearing out of the use or inability to use the materials on the internet website of FineShapeWorks even after a written or oral notification about the possibility of damage to FineShapeWorks or its authorized representatives. This is so because limitation on implied warranties, limitations of liability for consequential or incidental damages are not allowed by some jurisdictions. Therefore, it may not be applicable to you. In case of any damage which is not covered above, the total liability of FineShapeWorks will not exceed FIFTY PERCENT (50%) of the amount paid by the client last month.

11. Modifications and updates

There may be revisions in the terms of use for the website of FineShapeWorks without any prior notice. The user is bound by the current terms and conditions while using the internet website of FineShapeWorks. `

12. Governing law

Claims of any nature pertaining to FineShapeWorks 's website shall be governed by the laws of Delhi, India without regard to its law provision conflicts.  

13. Suggestions and feedback

If you send certain specific submissions like contest entries, creative ideas, proposals, suggestions or other materials at our request or on your own online via email or postal mail or by any other way ('comments'), you agree that we can without restriction, at any time, edit, publish, copy, translate, distribute and otherwise use in any comments that you send us. FineShapeWorks shall have no obligation to 1) pay any compensation for any comment or creative input, 2) respond to any comment, 3) maintain any comments in confidence. All personally identifiable information shared with FineShapeWorks will handle the information according to its privacy policy. You are restricted from posting any defamatory, threatening, libellous, obscene, inflammatory, pornographic, scandalous, profane material or any other material that is objectionable and that may give rise to any criminal or civil liability under the law.

14. Intellectual property rights, trademarks & ownership

The graphics and the files we create during any month paid in full are owned by you. The content or copy to be used in our designs needs to be provided by you. Any material provided by you to FineShapeWorks should be approved and proofed to be used in the design we create for you and is not trademarked or owned by a different entity FineShapeWorks is not liable if any materials provided by its clients infringe on the intellectual property of third parties. FineShapeWorks or its agents, representatives, successors, managers, officers, affiliates should be defended, indemnified, and held harmless by the client from all the damages, liabilities, claims and cost without limitation its reasonable attorneys' fees due to (i) your use of the services provided by the website of FineShapeWorks, (ii) breach of the any of the terms of this agreement by you, (iii) infringement of intellectual property rights of third parties or any other proprietary rights. 

15. Reselling

FineShapeWorks has a package, especially for the resellers. If you are a reseller, you agree to opt for the appropriate package otherwise your membership may be terminated. In such cases, the decision of FineShapeWorks will be final.

16. Miscellaneous

Your credit card information will always be encrypted during transfer over networks but some of the information may not be encrypted during the transfer and also during changes to adapt to technical requirements of various devices or other connecting networks. Any part of the service should not be duplicated, copied, sold, or exploited by you without written consent from FineShapeWorks. You are allowed to download and use the materials available on the Website of FineShapeWorks for personal use only if any material is not modified by you and the copyrights along with other proprietary notices contained in the available materials are retained by you. In any case, you are not allowed to reverse engineer or decompile any software on FineShapeWorks 's website, modify or copy materials, transfer or duplicate the material on any other server, eliminate copyrights, or any other proprietary notations from the data. Since the materials on this website are provided with "RESTRICTED RIGHTS", the permission to use any of the materials will be automatically ceased upon violation of any of the mentioned terms any time. You agree to demolish any downloaded materials from FineShapeWorks 's website (printed or in electronic format) in case of termination of your permission. FineShapeWorks reserves the right to refuse its service to a new or an existing client for any reason, any time.

17. Fees, payments and refunds   

You authorize FineShapeWorks to charge you on your mentioned mode of payment for its subscription fees on each anniversary of your registration date according to your billing frequency (i.e. monthly). The amount will be auto-debited on each billing date from your mentioned mode of payment. If you no longer want our services, it is your responsibility to inform FineShapeWorks in advance. You warrant that all the information provided by you is accurate and you have the authority to use the payment instrument. Any change in billing address or in the mode of payment should be communicated to FineShapeWorks by you as soon as possible. FineShapeWorks subscription can be canceled anytime. Upon cancellation, you will have the access to source files only for a specific term (to be decided by FineShapeWorks). FineShapeWorks may revise its fees from time to time. This will be done by posting the necessary changes on the website of FineShapeWorks with a 5 days' prior notice. However case of any reductions or temporary promotional offers, no such notice will be given. All kinds of refunds will be decided on case to case basis by FineShapeWorks.

18. Sample work

You agree and permit FineShapeWorks to publish the work we do for you in our Portfolio, Social Media, and other communication endeavors.

19. General Policy.

  1. The validity of a subscription plan is on a monthly basis.

  2. The pending work will be completed after the renewal of the subscription package.

  3. The service will be delivered according to the subscription plan/ package only. If user willing to take any service out of their subscription plan will be charged separately.

  4. We will not serve any kind of Video Editing or 3D work under any subscription package.

  5. We are not willing to copy any design of anyone and not under any liability if any other person will copy user’s a design/ work.

  6. The customer has to pay advance 50% to access our INSTANT SERVICE.

  7. If the user finds any difficulty with any of our Designer then he has the opportunity to contact to admin department for further assistance.

  8. Our designs are Individual, Innovative, and Creative. If finds any similarity with the designs of others that will be a coincidence only.

  9. After having the work done from our end, the user can patent the same to protect his design/ work.

  10. Unlimited work and revision mean a user can have an unlimited access option within the Subscription Duration.

  11. We assure every user to deliver their work on time as timely delivery is one of our USB.
